These Terms of Service ("Terms") constitute a legally binding agreement between you and Moonshot Travel ("Company," "we," "us," or "our") concerning your access to and use of our mobile application and website (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Moonshot Travel provides an AI-powered platform that helps users find and book flights, track price changes, and receive notifications about travel deals. Our Service includes:

Bookings and Payments

Booking Process

When you make a booking through our Service, you authorize us to book travel on your behalf with third-party providers. All bookings are subject to availability and the terms and conditions of the airline or service provider.

Pricing

Prices displayed on our Service are subject to change without notice. We strive to provide accurate pricing, but errors may occur. If we discover an error in pricing, we will notify you and give you the option to confirm your booking at the correct price or cancel.

Payment

You agree to pay all fees associated with your bookings. Payment is processed securely through third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method.

Refunds and Cancellations

Refund and cancellation policies are determined by the airline or service provider. We will assist with processing refunds and cancellations according to the applicable policies. Service fees may be non-refundable.

Moonshot Control Auto-Renewable Subscription

Moonshot Travel offers optional auto-renewable subscription plans:

Payment is charged to your Apple ID account (iOS), Google Play account (Android), or payment method on file (web) at confirmation of purchase.

Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

You can manage or cancel your subscription at any time:

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

For iOS and Android purchases, the Standard Apple EULA or Google Play Terms of Service apply respectively.

The Service and its original content, features, and functionality are owned by Moonshot Travel and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Service without our prior written consent.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONSHOT TRAVEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

We are not responsible for any damages or losses arising from flight cancellations, delays, airline policies, or actions of third-party service providers.

Indemnification

You agree to indemnify, defend, and hold harmless Moonshot Travel and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Third-Party Services

Our Service may contain links to third-party websites, airlines, or services that are not owned or controlled by Moonshot Travel. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

Your interactions with airlines and other service providers found through our Service are solely between you and such third parties. You agree that Moonshot Travel shall not be responsible for any loss or damage incurred as the result of any such dealings.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Term and Termination

These Terms shall remain in effect while you use the Service. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in the State of Delaware, and judgment on the award may be entered in any court having jurisdiction.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Moonshot Travel regarding the Service and supersede all prior agreements and understandings.
